By downloading, installing, or using Tiny Little Notes ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Pandora Cloud ("we," "our," or "us").

You must be at least 16 years old to use Tiny Little Notes. By using the App, you represent and warrant that you meet this age requirement.

If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

8. AI Assistant

8.1 Description

The AI Assistant feature uses artificial intelligence to provide suggestions, answer questions, and offer insights based on your profile data.

The AI Assistant is powered by Anthropic's Claude AI. When enabled, your queries and relevant profile data are sent to Anthropic for processing. See our Privacy Policy for details.

AI Assistant usage is limited to 50 queries per day per user. This limit resets daily.

You can share profiles with others by generating a unique share link or QR code.

Shared links can be set to expire after 24 hours, 7 days, 30 days, 90 days, or never.

You can export your data at any time through the App's Privacy & Security settings. Exports include your profiles, notes, photos, and other data in a portable format.

14.3 Data Deletion

You can delete your account and all associated data at any time. Deletion is permanent and cannot be undone. Some data may be retained as required by law.

While we implement robust security measures, no system is completely secure. We cannot guarantee absolute security of your data. You acknowledge this risk in using the App.

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AI-generated content may contain errors, inaccuracies, or inappropriate suggestions. You should not rely solely on AI suggestions for important decisions. The AI Assistant does not provide professional advice of any kind.

We are not responsible for the availability, accuracy, or content of third-party services integrated with the App (including Anthropic, Supabase, and others).

16. Limitation of Liability

16.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PANDORA CLOUD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL.

16.2 Cap on Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations of liability. In such cases, our liability is limited to the maximum extent permitted by law.

19.1 Governing Law

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles.

19.2 Informal Resolution

Before filing a formal dispute, you agree to contact us at support@tinylittlenotes.com to attempt informal resolution. We will work in good faith to resolve disputes within 30 days.

19.3 Arbitration (US Users)

For users in the United States, disputes that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules.

19.4 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES INDIVIDUALLY AND WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS.

You may not assign these Terms. We may assign our rights and obligations freely, including in connection with a merger, acquisition, or sale of assets.

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, or infrastructure failures.
